By accessing and using ProfitGuard, you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using or accessing this site.

2. Description of Service

ProfitGuard provides a platform for analyzing Amazon FBA inventory data to identify potential reimbursement opportunities. The service includes data synchronization, opportunity detection, case preparation assistance, subscription plan management, and commission tracking.

3. User Responsibilities

You agree to:

• Provide accurate and complete information when creating your account
• Maintain the security of your account credentials
• Not use the service for any unlawful or unauthorized purpose
• Comply with all applicable Amazon Seller Central terms of service
• Review and approve all claims before submission to Amazon

4. Amazon Integration

You grant us permission to access your Amazon Seller account data through Amazon's SP-API for the purpose of analyzing inventory, transactions, and returns. You retain complete control over what data is shared and may revoke access at any time through Amazon Seller Central.

5. Payment Terms

Subscription fees are fixed by plan. Commission is calculated on confirmed recovered amounts, but the payment flow is not finalized and may be handled later by invoice, digital contract, manual agreement, upfront payment, or payment after recovery.

6. Disclaimer of Warranties

The service is provided "as is" without warranties of any kind, whether express or implied. We do not guarantee any specific outcomes or reimbursement amounts.

7. Limitation of Liability

In no event shall ProfitGuard be liable for any indirect, incidental, special, consequential, or punitive damages arising out of your use of the service.

8. Termination

Either party may terminate this agreement at any time. Upon termination, your access to the service will be disabled, and your data will be handled according to our privacy policy.

9. Governing Law

These terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions.
